Bio

Mark Rotenberg has taught, written and spoken publicly on presidential authority for many years since serving in the Department of Justice Office of Legal Counsel, where he provided legal advice to the White House and executive departments on matters involving  national security, civil liberties, FOIA, and executive privilege. He has served as Professor of Practice at the University of Minnesota Law School, Adjunct Professor in the University of Minnesota’s College of Liberal Arts, and Visiting Professor at the Hebrew University Law School in Jerusalem, teaching in the areas of constitutional law and education law.



Mark has spent most of his professional legal career on university campuses, serving as the general counsel at the University of Minnesota and at Johns Hopkins University.  In those positions he provided strategic counsel and policy advice to university boards, presidents, chancellors, and other senior university executives. In addition to his chief legal officer positions, Mark has been special counsel at WilmerHale in Washington, working on higher education issues including free speech, campus protests and academic boycotts. He was also a litigation partner at Dorsey & Whitney in Minneapolis, specializing in employment, labor, and constitutional matters. He has argued and won cases in the U.S. Supreme Court and many other federal, state, and administrative forums, and is the author of numerous publications. A Proclamation issued by Minnesota Gov. Mark Dayton highlighted his litigation successes “in which the University [of Minnesota] recovered more than $600 million, among the highest recovery rates of any university counsel office in the United States.



Mark received his B.A., magna cum laude, from Brandeis University, and J.D. from Columbia Law School where he was an editor of the Columbia Law Review and a Harlan Fiske Stone Scholar.  He received M. Phil. and M.A. degrees from the Columbia University Graduate School of Arts & Sciences where he was a President’s Fellow in the Department of History.   Following his graduate studies Mark served as law clerk to Hon. Patricia M. Wald on the U.S. Court of Appeals for the D.C. Circuit.



Mark is a longstanding member of the American Law Institute (ALI), past Chair of the Association of American Universities (AAU) General Counsels Group, and is active in leadership roles for numerous political, educational and religious non-profit organizations. He has been interviewed in hundreds of broadcast and print stories.



Mark currently is Vice President and General Counsel of Hillel International in Washington, DC.
