A report by Associate Program Director Laura Draper points out that, while it is true that privacy is a right that cannot be compromised, two relevant aspects must be taken into account when discussing the role it plays in legislation.  First, although the privacy of the general user must be part of the analysis, the compensatory privacy interest of the abused child must also be taken into account. It is a serious invasion of your privacy when criminals post these images on the Internet and redistribute them. Secondly, the very concept of privacy requires a more nuanced analysis, according to the researcher. The strictest interpretation applied to communications tends to situate privacy as an absolute value that excludes the gaze of all parties, except the sender and the recipient. However, a more nuanced assessment could be made that conceives of privacy as the right to be protected against excessive government intervention or access by malicious actors, such as criminal hackers or private companies. When trying to balance user privacy with fighting online sexual abuse, policy makers need to be transparent in defining privacy, Draper concludes.
