Kevin Moriarty is a Senior Fellow with the Tech, Law and Security Program at American University’s Washington College of Law.

Kevin previously served as an advisor to Chair Lina M. Khan of the Federal Trade Commission, where he advised on the Commission’s privacy and security agenda. During his tenure in the Chair’s office, the Commission announced a series of groundbreaking privacy and data security matters, including: novel health privacy cases involving social media advertising tracking; the highest-ever monetary settlement under the Children’s Online Privacy Protection Act; a series of actions against location data brokers, including a first-of-its-kind federal lawsuit; a groundbreaking settlement involving the surreptitious collection and sale of consumers’ browsing information; and the unfair use of facial recognition software. He also advised on the Commission’s regulatory agenda, including the Commercial Surveillance Rule, the Children’s Online Privacy Protection Rule, the Health Breach Privacy Rule, and the Gramm-Leach-Bliley Act’s Safeguards Rule for financial information.

Prior to his service in the Chair’s office, Kevin spent ten years as a litigator with the Division of Privacy and Identity Protection of the Bureau of Consumer Protection of the Federal Trade Commission. He led the division’s first litigated data security case in federal court, which established the Commission’s jurisdiction to enforce the FTC Act to prohibit unfair data security practices. Kevin also led the division’s second federal court litigation, against a router manufacturer for unfair secure software development practices. Kevin also brought innovative privacy actions involving health, browsing, and television viewing information. He worked on the Commission’s first-ever action using Red Flags Rule of the Fair Credit Reporting Act and first action against an advertising exchange. Prior to the FTC, Kevin was an attorney in the intellectual property and appellate practice groups of Wilmer Cutler Pickering Hale and Dorr LLP.

Kevin is a graduate of Princeton University and New York University School of Law. Following law school, he served as a law clerk for Judge Edith Brown Clement of the United States Court of Appeals for the Fifth Circuit and Judge Robert S. Lasnik of the United States District Court for the Western District of Washington.
